Privacy Policy

1. Who we are

Fulkrum is a product of Aicounting, Inc. (“Fulkrum,” “we,” “us”). We provide an AI-assisted back office for small businesses — business formation, bookkeeping, payroll coordination, tax, and compliance services — through thefulkrum.com and our signed-in application. This policy explains what information we collect, how we use it, and the choices you have.

2. Information we collect

We collect information you provide directly to us:

  • Account information — your email address, used for passwordless sign-in and service communications.
  • Business information — details you provide during onboarding and while using the service, such as your company name, entity type, state of formation, employer identification number (EIN), ownership information, and business addresses.
  • Financial information — bank and credit card statements, transaction records, receipts, and other financial documents you upload or connect so that we can perform bookkeeping, tax, and related services.
  • Documents and communications — files you store in your document vault and messages you exchange with us, including conversations with AI-assisted features.

We also collect limited information automatically: log and device data (such as IP address and browser type) used for security, fraud prevention, and rate limiting. We use only essential cookies — a session cookie to keep you signed in and a preference cookie for your selected company. We do not use advertising cookies or third-party tracking.

3. How we use your information

  • To provide and operate the services — including preparing formation filings, maintaining your books, generating reports, and preparing tax filings you request.
  • To authenticate you (one-time sign-in codes) and send transactional communications about your account and services.
  • To secure the service — detecting, preventing, and investigating fraud, abuse, and unauthorized access.
  • To improve the services, in aggregate or de-identified form where practical.
  • To comply with legal, tax, and regulatory obligations, including record-retention requirements that apply to accounting and tax work.

4. AI processing

Some features use artificial intelligence provided by third-party AI service providers (such as Anthropic) to process information on our behalf — for example, helping categorize transactions or answering questions during onboarding. These providers process data solely to provide services to us and are not permitted to use your information to train their models. AI outputs used in your books or filings are subject to review workflows before anything is finalized.

5. How we share information

We do not sell your personal information, and we do not share it with third parties for their own advertising. We share information only:

  • With service providers who process it on our behalf under contract — such as cloud hosting and database infrastructure, email delivery (Microsoft), AI processing (Anthropic), and payment and financial services (Stripe and its banking partners).
  • With professional partners engaged to deliver services you request, such as registered agent providers or tax professionals.
  • With government agencies when we submit filings on your behalf and at your direction — for example, state formation filings, IRS forms, or tax returns.
  • For legal reasons — to comply with applicable law, regulation, legal process, or enforceable governmental request, or to protect the rights, safety, and property of Fulkrum, our users, or others.
  • In a business transfer— if Fulkrum is involved in a merger, acquisition, or sale of assets, subject to this policy’s commitments.

6. Security

We protect your information with technical and organizational measures, including encryption in transit, hashed storage of sign-in codes and session credentials, strict access controls, and rate-limited authentication. No method of transmission or storage is completely secure, but we work to protect your information against unauthorized access, alteration, and loss.

7. Data retention

We retain your information for as long as your account is active and as needed to provide the services. Financial and tax records are retained for longer periods where required by tax, accounting, and other applicable laws (commonly up to seven years). When retention is no longer required, we delete or de-identify the information.

8. Your rights and choices

You may access, correct, export, or request deletion of your information by contacting us at support@thefulkrum.com. We will honor deletion requests except where retention is required by law (for example, records supporting filed tax returns). Depending on where you live, you may have additional rights under applicable privacy laws, and we will honor valid requests as those laws require. We do not discriminate against you for exercising your privacy rights.

9. Children

Fulkrum is a business service intended for adults. We do not knowingly collect information from anyone under 18.

10. Changes to this policy

We may update this policy from time to time. If we make material changes, we will notify you by email or through the service before the changes take effect. The effective date above reflects the latest revision.
